A large law firm named ‘Kenalis Attorney at Law’ has raised a formal objection to the trademark. The firm says that there are many major procedural mistakes in this application, no strong evidence has been given before its use and this word is very common, which no one can make.
Reasons for trademark process and legal objection
The application made by MS Dhoni to register a trademark named ‘Captain Cool’ was printed in the Kolkata Trademark Office in June 2025. According to the rules, this trademark was published in the official journal on 16 June 2025 so that if anyone objected to it, they could register their protest. If there is no objection within 120 days from June 16, then the trademark Dhoni can get it. But a legal firm has issued a press release to raise strong objection to the registry’s move.
An objection has been lodged with MS Dhoni’s ‘Captain Cool’ trademark led by advocate Nilanshu Shekhar. Some important things have been said in this:
- Evidence was not given: The firm said that MS Dhoni’s claim was on the basis of “plan to use this name” earlier. He later said that he has been using it since 2008, but no strong evidence like bills, advertisements or data were given.
- These words are already common: The objection said that ‘Captain Cool’ is a common and praise -used word. It has been used even before Dhoni in cricket.
- Process disturbances: The firm says that the registry did not follow the necessary legal procedures while approving this trademark. A registered trademark already existing was not considered and necessary notices were also not sent.
- No concrete evidence of identity: It was claimed by Dhoni that this name has now become his identity, but according to the firm, no adequate evidence was given in the popularity of this name or its use in sports.
Why Dhoni wants the trademark of ‘Captain Cool’?
Mahendra Singh Dhoni has applied for a trademark under Class 41 to register the name “Captain Cool” in his name. This class is associated with things that are related to studies, training, entertainment, sports and cultural activities. Dhoni wants only to use the name “Captain Cool”, especially in sports training and coaching, so that no one else can use this name for business.
