New Delhi: The Supreme Court on Tuesday questioned during the hearing in the Pegasus espionage case that if the country uses espionage software against terrorists, then what is wrong with it? The court said that no documents related to the security and sovereignty of the country would be made public. However, the court also said that complaints of those who are afraid of breach of privacy can be considered. The court has listed the case for hearing on 30 July 2025.

‘The security of the country cannot be compromised’

Justice Surya Kant and Justice N. The bench of Kotiswar Singh said, ‘The security of the country cannot be compromised. If detective software is being used against terrorists, it is not wrong. But this question is important against whom it is being used. The court also clarified that the confidentiality of private persons would be protected under the Constitution.

Kapil Sibal and Shyam Dewan gave these arguments

Advocates Kapil Sibal and Shyam Dewan, on behalf of the petitioners in the Pegasus detective case, argued that the report of the technical committee should be made public. Sibal, citing a decision of the US court, said that WhatsApp himself admitted that his system was hacked. He demanded that people whose phones were hacked should be given at least revised reports. At the same time, Solicitor General Tushar Mehta said that the use of espionage software against terrorists is fine and they cannot be given the right to privacy. He suggested against any comprehensive investigation.

What is the Pegasus case?

Pegasus is an Israeli detective software, allegedly spying on leaders, journalists and activists in India. In 2021, the Supreme Court formed a technical committee to investigate the case, which was monitored by former judge Justice R.K. V. Ravindran was doing. This committee examined 29 phones, out of which malware was found in 5, but it was not proved that Pegasus was used. The Supreme Court has set the next hearing of the case on 30 July 2025. The court will also see to what extent the technical committee report can be made public. (With PTI inputs)
