The Department of Revenue and Land Reforms has taken an important and far-reaching decision to remove the complications arising during land acquisition in consolidation villages. The move aims to save development projects from getting stuck and to provide justice to real land holders.

Deepak Kumar Singh, Additional Chief Secretary, Revenue and Land Reforms Department, has issued clear instructions to the colleges of all the districts across the state. He has said that in cases where Khatian, Jamabandi and ground possession are found, there will be the same person entitled to compensation, who really holds the ground – whether it is not Khatian or Jamabandi.

Consolidation process and current status

Under the Bihar Consolidation Act, 1956, the process of consolidation was started in 5657 villages of the state. Out of these, this process has been completed in 2158 villages and related notifications have also been issued. But practically, the occupation of the ryots in many places is still maintained on the basis of the old survey Khatian (CS/RS), while the Jamabandi of Khatian and Register-2, built under consolidation, has been updated.

This contradiction often hinders compensation distribution, especially when the process of government acquisition is going on on a land. The department was constantly receiving complaints that online records, consolidation Khatiyan and real possession on the land are not interacted, causing legal confusion and delay in development works.

Real occupiers will get compensation

While resolving this problem, the Additional Chief Secretary said that the person who is actually occupying the Khesra or Khesra parts is being occupied-if he is not an encroachment and his claim is certified by an old Khatian or associated transaction-it will be commented as a beneficial ryot.

This will ensure that the real beneficiary gets compensation during land acquisition, not the person who is recorded only in the record but has no right or possession of the land.

Proof based payment process

District Land Acquisition Officers have been directed to pass self-contained orders in all such cases, in which it is clearly mentioned on which person is paid. This order is necessary so that no legal dispute arises in future and the entire process remains transparent.

Although this is an interim arrangement, the department has also taken legal consultation for this and the process of necessary amendment in the relevant acts has also been started. This decision has been implemented with immediate effect without waiting for the amendment, so that there is no obstruction in the speed of development works.

Decision to protect the interests of ryots

This decision is not only important from the administrative point of view, but it is also a protecting the interests of the ryots. This will give justice to the real land holders who have been on the ground for years but were deprived of compensation due to record related discrepancies. Now compensation will be distributed by making balance between the records and reality, so that development projects will also be able to move faster.
