Husband gives Rs 1.25 crore to wife, Supreme Court’s big decision in alimony case

New Delhi: The Supreme Court ended the marriage of a couple on Thursday and directed the person to pay Rs 1.25 crore as permanent alimony to the person living separately. A bench of Justice Vikram Nath and Justice Sandeep Mehta said that the couple had been living separately since 2010 and the person had married second in March 2017. The bench said, “We see no justification for continuing legal relations between the two sides. The marriage is completely broken.”
What did the Supreme Court say?
The apex court passed the verdict on an appeal filed by the person against the Madras High Court’s order of August 2018. The High Court accepted the woman’s petition and canceled the divorce decision given by a family court in October 2016. The Supreme Court said, “It is clear that there is no scope for reconciliation between the two sides. They have been living separately since 2010 i.e. for about 15 years. There is no marital relationship between them and no party has shown any desire to resolve their differences.”
Permanent alimony to woman and her son
The court, terming it a suitable case to divorce, used its extraordinary powers gained under Article 142 of the Constitution. The apex court also thought it appropriate to give a lump sum amount to the woman and her son as permanent alimony. It was brought to the attention of the court that the person did not provide financial assistance during the legal battle. The apex court said, “We direct the appellant to pay Rs 1.25 crore as permanent alimony and all other claims of the wife will be considered completely.” (With language inputs)
