In the Lok Sabha, Home Minister Amit Shah introduced the 130th Constitution Amendment Bill 2025. This bill provides for the resignation of the Chief Minister, the State Minister. Under this bill, if the Prime Minister, Union Minister and Minister of State are arrested, they will have to withdraw from the post. At the same time, this rule will be applicable even after the arrest of the Chief Minister and ministers of the union territories. He will be removed from the post even if he is detailed in the Serious Criminal charge.

Why should resign be necessary after arrest?

Reason no. 1- A fair investigation can be done.
Reason no. 2- Could not pressurize the investigating agency/officer.
Reason no. 3- Witnesses cannot be affected.
Reason no. 4- Do not try to erase evidence.

These cases were in discussion recently

Explain that recently the investigation agencies arrested Chief Ministers and Ministers of some states in different cases. But one of the Chief Ministers did not resign despite arrests. In fact, the Enforcement Directorate (ED) arrested the then CM of Delhi Arvind Kejriwal in a case but did not resign from his post despite going to jail.

At the same time, ED also arrested the then CM of Jharkhand Hemant Soren in a case but he resigned from the post. Apart from this, former Deputy Chief Minister Manish Sisodia has also been arrested. In such a situation, if the new bill is passed, then it will directly mean that the leader sitting on the post will have to leave the chair.
