Consumer Commission imposed a fine of Rs 5,000 on Intex Technology; The company did not change the power bank

Chandigarh District Consumer Disputes Redressal Commission has imposed a penalty of Rs 5,000 on Ahmedabad-based Harikrishna Communication and Intex Technology (India) for not replacing the defective power bank within the warranty period. Along with this, the Commission has also directed the dealer to return the purchase amount of the power bank of Rs 770 along with 6 percent annual interest to the complainant.

what is the matter
Rikash Goyal, a resident of Industrial Area Phase-1, Chandigarh, lodged a complaint with the Commission and said that he had purchased a power bank from Harikrishna Communication for Rs 770 after seeing an advertisement on Amazon’s website on July 22, 2020. On September 26, during the trip to Himachal Pradesh, when I used the power bank, I found that it was not working.
After this, on September 28, he came in contact with Bharat Enterprises located in Sector-41, where he was told that the company would not replace the power bank with a new one. On October 10, he received a message on his mobile that his product was ready, and the job sheet had been closed.
When the complainant reached the service center on October 12, he was given a used, old power bank with scratches. The complainant protested, but the company neither replaced the old power bank nor provided a new power bank. Considering this entire act as deficiency in service and unfair trade practice, Rickash Goyal approached the Consumer Commission.
The Commission held Harikrishna Communication and Intex Technology (India) guilty of deficiency in service and unfair trade practices and ordered it to return Rs 5,000 as compensation and Rs 770 with 6 percent annual interest.
