SC’s instruction to the Center, consult NBSA for social media content control

The Supreme Court has directed the Central Government to present a record on its proposed guidelines to control the content aired on social media, including various types of materials. The court has ordered that these guidelines be prepared in consultation with news broadcasting Standards Authority (NBSA). The government has been given time till the next hearing of the case in November.

The Supreme Court on Monday said that influential people on social media commercialize freedom of expression. Their comments are likely to hurt the feelings of diverse society, including disabled, women, children, senior citizens and minorities.

Work should be done on guidelines

A bench of Supreme Court Judge Suryakant and Judge Joymalya Bagchi told the central government to work on the guidelines in consultation with the National Extension and Digital Association to regulate the conduct on social media including online shows like Podcast, which is represented by Advocate Nisha Bhabhani, so that the freedom of expression and the equal rights of various communities can be made with respect to the society.

The court on Monday was hearing the case of ‘misuse of freedom of expression’ by creating insensitive jokes about persons with disabilities against social media comedians including Raina on Monday.

Judge Bagchi said, “When you are commercializing freedom of expression, you should also keep in mind that the feelings of some sections of the society do not hurt.” Judge Kant said that the constitutional objective of bringing insensitive jokes about disabled persons has been completely demolished.

Judge Bagchi admitted that humor is an integral part of life, but lightness should not cause sensitivity. He reminded, “We are a country of various communities.” Judge Kant said that guidelines should be prepared in such a way that the violation of the violation will definitely bring specific results.

Judge Kant said, ‘Unless effective results are fixed, people can wander around to escape the responsibility. The results should be in proportion to the loss. They cannot be only formalities. ‘ The judge clarified that the court is not trying to curb freedom of expression even for a moment, rather he is expecting from the proposed guidelines that they will draw a line between freedom of expression and a speech that hurts.

Social media users have to be sensitive

Attorney General R.K. Venkataramani replied that the primary objective of the proposed guidelines would be to make social media users sensitive. But if someone violates, he will have to take responsibility. Many of these media blogs are like nourishing your ego.
