Jaipur. The Permanent Lok Adalat of Jaipur Mahanagar I has considered pre-mature delivery by declaring the death of the baby in the womb and the subsequent death of the baby as serious negligence. Along with this, the court has imposed a compensation of Rs 5.20 lakh on the principal and controller of the opposition MMS Medical College and the superintendent of Zanana Hospital. The court said that the opposition should pay the compensation amount to the complainant within thirty days. Lok Adalat Chairman Manoj Kumar Saharia and Member Seema Shardul gave this order on the application of Beena Meena. In the application, advocate Viji Aggarwal said that during pregnancy, the applicant started treatment under the supervision of Zanana Hospital. She underwent ultrasonography on November 1, 2023, which revealed the death of the 25-week-old fetus. While the applicant said that she could feel the movement of the fetus in the womb, but the doctors told her that if the fetus was not removed immediately, she could die due to infection. After this, her pre-mature delivery was done by giving injection on 9 November 2023. In this, she gave birth to a live baby and told her to send the child to the ward. It was said in the application that about three hours after the delivery, she was told that the baby had died due to pre-mature delivery. On this, an application was presented in the court and requested for compensation amount. In response to this, the hospital administration said that due to crowd of patients and more work, changing the sonography cannot be ruled out. The doctor of the unit had taken the decision of delivery based on sonography only. Every possible effort was made to save the baby and he was first admitted to the NICU and then put on a ventilator, but he later died. In such a situation, there has been no negligence on their part. After hearing the arguments of both the parties, the court has imposed damages on the hospital.
