After Himachal Bhavan, now orders for attachment of Bikaner House
New Delhi, November 21 (IANS). After the order to attach Himachal Bhawan located in Delhi, Patiala House Court has also ordered to attach Bikaner House.
The court has issued this order for non-compliance of the arbitration agreement between Rajasthan’s Nokha Municipality and Enviro Infra Engineers Private Limited.
The bench of Commercial Court Judge Vidya Prakash in Delhi’s Patiala House Court gave this order. He said in his order that on January 21, 2020, following the dispute between Enviro Infra Engineers, the municipality was ordered to pay Rs 50,31,512 lakh. But despite this the municipality did not pay the amount to the company.
The next hearing in the case will be on November 29. The court has ordered the Nokha Municipality representative to appear in the court on that day.
Earlier, Himachal Pradesh High Court had issued an order to attach Himachal Bhawan located in Delhi. The order was issued after the Congress-led Sukhwinder Singh Sukhu government failed to pay electricity dues of about Rs 150 crore.
The court has also directed the Principal Secretary of the Electricity Department to conduct a fact-check to identify the officials responsible for this negligence.
The court order came after the Sukhu government ignored previous orders to repay Rs 64 crore, which has now increased to about Rs 150 crore due to interest.
The matter was raised in the context of the 400 MW Seli Hydro Project to be built on the Chenab River in Lahaul-Spiti. The court made it clear that this amount is going from the state treasury, the loss of which will have to be borne by the public, hence the company has been allowed to recover its amount by auctioning Himachal Bhawan.
Earlier, the state government had received an order to return the advance amount of Rs 64 crore deposited by the company with seven percent interest. After the Himachal Pradesh government disobeyed this order of the court, the amount including interest has now reached Rs 150 crore. The next hearing in this case has been fixed for December 6.
