According to HT’s news, the new apartment Overception Act can give a new look to the control and maintenance of the Residential Apartments across the state including Bangalore. Significantly, the apartment ownership act right now is decades old. There are many types of flaws in it. Due to this, the new apartment ownership act is now being brought. This new act will bring more clarity on issues like land ownership, common area ownership and maintenance.
Will replace the current law of 1972
The new apartment will replace the Overception Act, the current law of the year 1972. This step is the Deputy Chief Minister of the state D.K. After the announcement by Shivkumar, he said that “We are bringing a new law which will be within the purview of the RERA law and will replace the old Karnataka Apartment Oarship Act, 1972.”
Will solve the problem of home buyers
The new law will solve the problems of homebeelers i.e. flats for a long time. The current law has no clear rule to transfer the common area (stairs, parking, club houses etc.) to the flat owners’ society on time. For this reason, many apartment owners have been forced to move to the court. According to Section 17 of the RERA law, the builder has to transfer all common areas to the society after the project is completed, but it is not being followed in the old law yet.
What are homebires demanding in the new law?
Homebayers want the land, buildings and all common areas to be transferred to the society within the stipulated time in the new Act.
