Bills removing tainted PM-CM presented in Lok Sabha, sent to JPC after opposition from opposition
Bills to remove corrupt PM-cm introduced in Lok sabha: 3 Bills were introduced in the Lok Sabha on Wednesday to provide provisions to remove the Prime Minister, Chief Ministers and Ministers detained for 30 consecutive days, and the House decided to send it to the Joint Committee of Parliament for study. Union Home Minister Amit Shah introduced the ‘Constitution (130th Amendment) Bill’, ‘2025’, ‘Union Territory of Government (Amendment) Bill, 2025’ and ‘Jammu and Kashmir Reorganization (Amendment) Bill, 2025’ amid opposition and uproar by the opposition. Later on his proposal, the House decided to send the three Bills to the Joint Committee of Parliament.
The objectives and reasons of the bills states that a minister who is facing allegations of serious punishable offenses is arrested and kept in custody, then he can fail or obstruct the principles of constitutional morality and the principles of good governance and ultimately reduce the trust expressed by people. According to this, there is no provision under the Constitution to remove such a minister which is arrested under serious punishable allegations.

It said that in view of this, in such cases, there is a need to amend the Articles and Related Acts of the Constitution to remove the Chief Minister or the Chief Minister or Ministers in the Council of Ministers of the Prime Minister or the State, Delhi National Capital Territory and Puducherry, to remove the Chief Minister or Ministers of the Union Territory and to remove the Chief Minister of Jammu and Kashmir Union Union Territory.
According to the draft of the Constitution (130th Amendment) Bill, 2025, if a minister is arrested for a thirty consecutive day period on charges of a punishable offense of five years or more, for a period of thirty consecutive days and is kept in custody, he will be removed from the post by the President on the advice of the Prime Minister till 31st day.

But if the Prime Minister’s advice was not given to the President for the removal of such a minister till the 31st day, then he will not remain a minister from the coming day. According to the bill, a similar provision is also proposed in the case of Chief Ministers and Ministers of the Prime Minister, States, Delhi and Puducherry Union States.

Similarly, in the case of union territories, the Union Region Government (Amendment) Bill, 2025 and the Jammu and Kashmir Union Territory to amend the Union Region Government Act, 1963 and introduced the Jammu and Kashmir Reorganization Act, 2019 and the Jammu and Kashmir Reorganization (Amendment) Bill, 2025 were introduced.
