Difference between mother and step mother, see role in child’s life: Supreme Court | Atua loktantra
 
The Supreme Court heard the case of refusing to give pension benefits to the Indian Air Force step mother. The court said- ‘Mother’ and ‘organic mother’ should not be differentiated in pension schemes.
The court said- Every case should be seen based on its specific facts and it should be decided who actually played the mother’s role in the child’s life.
Hearing of the case, Justice Suryakant, Justice Ujjal Bhuiyan and Justice N. Kotishwar Singh did it. Justice Bhuiyan said- ‘Mother’s biological mother is not necessary in the pension case.
In 2010, the Air Force rejected the appellant’s special family pension claim. The next hearing of the case will be held on 18 September.
Effect of this case
According to Gupta, there are several decisions about the legal rights of adopted son, live in and second wife. Giving the step mother the same legal rights as a biological mother can expand the scope of other pension schemes of the government, but for this the Parliament and the government will have to change many laws of family and succession with pension.
