Ejaz Khan filed an anticipatory bail petition in the court to avoid arrest in the rape case. A sessions court in Mumbai rejected Ejaz Khan’s anticipatory bail plea on Thursday. Additional Sessions Judge D.G. Dhobale refused to accept Ejaz Khan’s claim that he had a relationship with the actress with consent.

The judge said that in view of the seriousness of the case, inquiry is necessary in the custody of Ejaz Khan. The court said, the content on the record shows that the applicant is married and is an actress by profession. Although the victim is adult, but considering the allegations, it seems that consent is not independent and clearly in the sense of law.

The court said, “Inquiry in Ejaz Khan’s custody is necessary to collect other digital evidence including his medical examination, recovery of his mobile phone, whatsapp chat and call recording confirmation and voice samples.

Ejaz Khan’s lawyer claimed that both were adults and their relationship was with mutual consent. He also showed some WhatsApp chats and audio recording to the court, who is accused of demanding money to return the case.
