There is violation of privacy

People have been given some fundamental rights in the Constitution of India. One of these rights is also of privacy under Article 21. It is known as Right to Privacy. For this reason, if you take a picture or video of someone without permission and upload it on social media, it will be considered a violation of the privacy of that person. In such a situation, if the person forward complains to the police, then you can also be sentenced to jail.

What is the provision of punishment?

Action can be taken in such cases under the IT Act or Information Technology Act, 2000 in India. Section 66E of the Act prevents a person from taking pictures without permission and posting it on social media and considers it a violation of privacy. On doing this, a provision of punishment has been made. On doing any such work, the convict can be imprisoned up to 3 years or a fine of up to Rs 2 lakh or both.

  • Section 66E: To take a picture of one’s private organs without permission, it falls under the category of crime. The convict may be imprisoned for 3 years in jail or a fine of Rs 2 lakh or both punishment.
  • Section 67: It is a crime to transmit pornographic materials through the Internet or any electronic medium. The convict can be punished for the first time imprisonment up to 3 years and a fine of up to Rs 5 lakh. At the same time, if found guilty for the second time, imprisonment of up to 5 years and a fine of up to Rs 10 lakh can be punished.
