Vacant common land, which is also called government land, if someone has illegally occupied it, then the government will take that land back. In such a situation, if someone does not have the land documents, then he can get the land documents made. . If someone does not have land documents then he can get his land documents made from the land boundaries of nearby people. There is an English law called Adverse Position. Under this, ownership rights of that land can be registered after continuous possession for 12 years. But the condition is that during the period of 12 years no one else has claimed possession or made any kind of obstruction. The Supreme Court also resolved a dispute by giving its verdict on this issue, in which the Supreme Court said that the person who has possession of the land for 12 years will be considered the owner of that land.

The Supreme Court bench has said that if no one shows ownership of that land for 12 years, then whoever has occupied that land will be considered its owner. However, this decision of the Supreme Court is related to private land. This decision will not be applicable on government land. While giving the verdict related to land acquisition, the Supreme Court said that Indian law gives a person the right to assert his rights on the land for 12 years. If any land is disputed, any person can file a lawsuit claiming his rights over it and get it back from the court within 12 years. Let us tell you that under the Limitation Act, 1963, there is a right to claim ownership of private property. The time limit for land is 12 years, whereas on government land this limit is 30 years. A complaint of forcible possession will have to be filed within 12 years.
