Supreme Court petition to dismiss Sri Lankan person
New Delhi: India is not a Dharamshala, where refugees from all over the world can be given shelter, the Supreme Court today made important remarks, dismissing the plea of a Sri Lankan citizen. The bench of Justice Dipankar Dutta and Justice’s Vinod Chandran was hearing the plea of a Sri Lankan citizen, who was arrested in 2015 on suspicion of being associated with Liberation Tigers of Tamil Eelam (LTTE), which was once a terrorist organization operating in Sri Lanka.
Petitioner pleaded
In the year 2018, a trial court convicted the man under the illegal activity (prevention) Act and sentenced him to 10 years in jail. In 2022, the Madras High Court reduced his sentence to seven years, but asked him to leave the country as soon as the sentence was completed and stay in the refugee camp before exile. The petitioner told the Supreme Court that he had come to India with a visa and threatened his life in his country. He also said that his wife and children have settled in India and have been in custody for almost three years and the process of exile has not started.

In response to the petition, Justice Dutta said, “Is India to host refugees from all over the world?
The petitioner’s counsel argued on the case under Article 21 (security of life and freedom) of the Constitution and Article 19, which gives fundamental rights including expression and freedom of transport. Justice Dutta said that the petitioner’s custody does not violate Article 21 as he was detained according to the law.

After this, the court said that Article 19 is available only to Indian citizens. The court asked, “What is your right to settle here?” When the petitioner’s counsel stressed that he is a refugee and threatened his life in Sri Lanka, the court asked him to move to another country.
