Jammu and Kashmir will get state status? Supreme Court hearing on the petition filed on August 8

According to the report of Live Law, the Supreme Court will hear a petition demanding the Central Government to reinstate the state status of Union Territory of Jammu and Kashmir on Friday, August 8. Senior advocate Gopal Shankaranarayanan mentioned the matter before Chief Justice of India BR Gavai and said that it was shown listed for August 8. Gopal Shankaranarayanan requested that the matter not be removed from the list of that day. The report further stated that Justice Gawai accepted the request.
370 removed on August 5
Explain that on August 5, 2019, the Center abolished the special status of Jammu and Kashmir and the state was divided into two union territories. According to the report, the petition was in the form of a diverse application “regarding Article 370 of the Constitution”, in which the Supreme Court retained the decision to cancel the special status of Jammu and Kashmir.
However, in that historic judgment given in December 2023, the Constitution Bench had avoided the Solicitor General’s assurance that the status of the state would be “as soon as possible”, refraining from giving a decision on the constitutionality of the Jammu and Kashmir Reorganization Act, 2019, which divided the state into two union territories. The court then commented: “State status should be restored as soon as possible and as soon as possible,” but no time limit was set.
Petition was filed
Recently, this petition was filed by college teacher Zahoor Ahmed Bhat and social activist Khurshid Ahmed Malik. Presented by Advocate-on-Chard Ejaz Maqbool, the applicants argue that despite the assembly elections in the area, the central government has failed to take any steps towards restoring state status in eleven months since the decision.
