The two -member bench headed by Justice Suryakant and Justice Joymala Bagchi is hearing petitions challenging the constitutional validity of SIR. Senior Advocate Kapil Sibal appeared on behalf of the petitioners.

What did Kapil Sibal say?

Senior Advocate Kapil Sibal said that every person born after 1950 is a citizen of India but there is a huge disturbance in the process here. What did the Supreme Court say to the Election Commission?

At the same time, senior advocate Rakesh Dwivedi, appearing for the Election Commission, said that this is just a draft role. On this, the bench told the Election Commission to be “ready” with facts and figures as the number of voters before the process starts, the number of earlier dead and now the number and other relevant details would be questioned.

What did the Supreme Court say in the last hearing?

In the last hearing, the Supreme Court refused to stay the SIR and asked the Election Commission to complete the process. It was also said that if a large number of names are removed, the Supreme Court will interfere in it. There is a dispute over the deducted 65 lakh names in the draft list. In the petition filed by the Association for Democratic Reforms (ADR) in the court, it was claimed that 65 lakh voters were affecting the reasons without which the Election Commission said that the SIR was being legally done.

What is the opposition accusing?

The Election Commission released the first phase of Bihar SIR on 27 July. It was informed that 65 lakh names in Bihar will be removed from the voter list. Of these, 22 lakh voters have died, 36 lakh people have been permanently transferred, while about 7 lakh people were found to be more than one place. The opposition is accusing the Election Commission of acting in favor of BJP, while BJP alleges that the opposition is making a concoction for fear of defeat in the election.

Opposition parties are constantly making uproar on this issue. On Monday, opposition MPs led by Rahul Gandhi in Delhi tried to march to the Election Commission on the issue.
