Jamiat Ulama-e-Hind President Maulana Mahmood Asad Madani has welcomed the Supreme Court’s decision on the minority character of Aligarh Muslim University (AMU), calling it important and of far-reaching consequences. Maulana Madani said that this decision has also shown the mirror to the present government which was hindering the restoration of minority status and had adopted the stand of abolishing the minority character in the court against the stand of the previous government.

Maulana Madani said that Jamiat Ulama-e-Hind has always fought for the educational and constitutional rights of Muslim minorities. An example of this is the recent effort to stop the negative campaign against religious seminaries by government and non-governmental organizations. Similarly, when the Supreme Court’s decision in the Aziz Basha case came in 1967, Jamiat Ulama-e-Hind, under the leadership of Fida-e-Millat Maulana Syed Asad Madani, fought a long battle against it inside and outside the Parliament for 14 years. In this background, an ‘All India Convention for Aligarh Muslim University’ was organized on 29 August 1981 under the auspices of Jamiat Ulama-e-Hind. A large number of representatives from every corner of the country participated in it. In this conference, Jamiat Ulama-e-Hind strongly demanded from the Government of India that the minority character should be restored by passing the Muslim University Amendment Bill in the Parliament session.

Maulana Madani said that as a result of this long struggle of Jamiat Ulama-e-Hind, the Parliament passed the Act in 1981. However, due to the bureaucratic mentality, some loopholes were left in the Act, leaving the door open for interference and as a result, in 2006, the Allahabad High Court once again abolished the minority status. In the year 2006, Jamiat Ulama-e-Hind met Dr. Manmohan Singh in the context of this decision and advised him to challenge the decision of the High Court in the Supreme Court, on which the then government also took action and the Government of India itself. Presented its stand in the Supreme Court through an affidavit, but after 2014, the NDA government moved away from its previous stand and filed an affidavit in the court in favor of abolishing the minority status. Jamiat Ulama-e-Hind has fought every possible way against this attitude of the government for the last ten years.

Maulana Madani said that Jamiat Ulama-e-Hind has long believed that Aligarh Muslim University, which is a priceless heritage of the Muslims of India, should remain safe and continue to successfully achieve its goals, For which it was established. Especially in the background that Muslims today are extremely backward educationally and this has been confirmed by various reports, changing the character of institutions established for Muslim minorities is actually an attempt to antagonize Muslim minorities and push them towards further backwardness. Is.

Maulana Madani, on this occasion, appreciated the legal struggles of the organizations AMU and AMU Old Boys Association and other interveners in the Supreme Court. Maulana Madani especially appealed to the Muslim minorities to pay attention to education and play their role in the development of the country and society by getting higher education.

It is noteworthy that the seven-member Constitution bench of the Supreme Court today by majority rejected the 1967 Syed Aziz Basha vs. Union of India judgment on the minority character of AMU. Today, the Supreme Court led by Chief Justice of India DY Chandrachud overturned its own earlier decision and said that the minority character of an institution cannot be extinguished merely on the ground that the institution has been established by an Act of Parliament. . Along with this, a bench of three judges of the Supreme Court will decide the status of AMU as a minority institution.
