Mukhtar Ansari’s elder son Abbas has got a big relief from the Allahabad High Court in the Hate Speech case. On Wednesday, High Court Justice Sameer Jain stayed Mau’s MP/MLA court decision in which Abbas was sentenced to 2 years.
On the High Court’s decision, the legal expert says that now Abbas Ansari’s legislature will be restored.
The case is related to the 2022 assembly elections. Abbas was contesting from Mau on Subhaspa ticket. In a public meeting, Abbas had said- I have come to tell SP chief Akhilesh Yadav, no one will be transferred for 6 months after the formation of the government. Wherever it is, it will remain there. First there will be an account, then there will be transfer. At that time there was an alliance of Subhaspa and SP.
After this, an FIR of Hate Speech was registered in the city Kotwali. On 31 May, Mau’s MP/MLA court sentenced Abbas to 2 years in the case. The file reached Lucknow from Mau within 24 hours of the court order. Then on Sunday, (June 1), their membership was terminated by opening the Assembly Secretariat on the day of the holiday and the seat was declared vacant. However, the by -election was not announced.
What will happen now?
Legislature experts believe that due to the postponement of the sentence, now Abbas will apply to restore membership in the assembly. The assembly will have to restore their membership.
Principal Secretary Home Sanjay Prasad has spoken to Additional Advocate General Mahesh Chandra Chaturvedi. Chaturvedi has advised him to appeal to the Supreme Court in the case. Now the government will file an appeal in the Supreme Court.
Abbas’s lawyer Upendra Upadhyay said- on July 17, a petition was filed in the High Court against the sentence. Our demands were accepted by the court and stopped the sentence. A total of 5 trials were held in the case. The court reserved the verdict after the debate was completed on 13 August.
He said, we had argued that there is no criminal case on the content of the speech. The sections in which the punishment was done was not appropriate. This could have been a case of violation of the maximum code of conduct, which was unnecessarily converted into a criminal case.

Another name for life is the struggle: this is the victory of justice, what to say more than this. Now the order comes, then see what is, what is not. Right now this is a verbal order, the order will come by evening. Abbas said, struggle is life, another name of life is struggle.
Governance is a power, do anything: In the case of forgery, when younger brother Omar Ansari was sent to jail, Abbas Ansari said without naming anyone, the government is power, do whatever he wants. But there is a court, the constitution, we are sure that justice will be received.
All permission to prepare for the election: Abbas Ansari said for leaders and parties, preparing to contest from Mau Sadar seat, “There is democracy, everyone has the freedom to prepare for elections.” Anyone can contest elections. But Awam is at the top. Whatever he can win, everyone is in the hand of the people.
