Now UCC must be implemented: East CJI, to all castes, communities and classes

Former CJI DY Chandrachud said on Saturday that the Constitution expresses the desire for the Uniform Civil Code. 75 years after the Constitution, the time is now to achieve this goal. He also said that this step should be taken only by taking all castes, communities and classes of the country in confidence.

Former CJI was speaking at the release program of Congress MP Shashi Tharoor’s new book ‘Hour Living Constitution’ on Saturday. During this time he said,

On the alleged threat on the constitution and the opposition’s concern over constitutional institutions, he said that the Constitution is forever. In the last 75 years, there have been several rounds of governance, epidemic and internal-hatred challenges, but the Constitution worked to give stability to the country.

On July 11, former Chief Justice of India (CJI) DY Chandrachud had said, “The elections of Lok Sabha and Assembly together are not a violation of the basic structure of the Constitution.” However, he has expressed concern over the powers given to the Election Commission (ECI) in the proposed bill.

The former CJI had said that this could give ECI the power to increase or decrease the term of the assemblies. Circumstances should be defined in which ECI can use this power.

Justice Chandrachud had handed over his written opinion to the Parliamentary Committee on one country-one election. Law Minister Arjun Ram Meghwal introduced a country-one election constitutional amendment bill in the Lok Sabha on December 17, 2024. Modi said- I call UCC a secular civil code.

Prime Minister Narendra Modi said in Haryana on 14 April- Whenever the Congress showed the power crisis, he crushed the constitution. The spirit of the constitution is that there should be a similar civil code for everyone, which I call a secular civil code. The Congress never implemented it. After coming to the BJP government in Uttarakhand, the Secular Civil Code came into force to the injury of Danke. The people of the Congress sitting in the pocket of the constitution are opposing him.

23rd Law Commission will prepare the final draft of UCC

The 22nd Law Commission headed by Justice (Retired) Rituraj Awasthi prepared a draft of the UCC and released it for public opinion. The commission had received the opinion of about one crore people on this.

The 22nd Law Commission had interacted with around 30 organizations. But with the end of the term of the Commission, the work of preparing the final draft of UCC went on hold.

However, now the Law Commission is being activated again to proceed on the UCC. The notification of the 23rd Law Commission was issued on September 2, 2024. Now after about 7 months, it has been decided on the appointment of its president and members.

Justice Dinesh Maheshwari, who retired from the Supreme Court in May 2023, will be made the chairman of the commission. He will be accompanied by well-known lawyer Hitesh Jain and Professor DP Verma. Notification of their appointment will be released this week.
