Rajat Sharma’s Blog | Modi’s attack on corruption: Those who go to jail, leave the chair

Narendra Modi’s government took a big step to prevent corruption in politics. The government introduced three bills in the Lok Sabha, in which there is a provision that if a person sitting on a constitutional post like Prime Minister, Chief Minister or Minister goes to jail for 30 days in a case, then his chair will go on its own.
Since there is no such provision in the law so far that if the head of a government or minister goes to jail in a serious charge, stays in jail for a long time, he does not get bail from the court and does not even resign, then what to do in such a way? No one can dismiss the jailed Chief Minister or Minister, no court can remove him from the post. The question was also whether a Chief Minister could run a government from jail? Can you sit in jail and handle the functioning of the ministry? The answers to these questions are in these three bills which were introduced by Home Minister Amit Shah in the Lok Sabha.
Since the constitution has to be amended for such changes, this bill has been named the 130th Constitution Amendment Bill. This bill will have to be passed in both houses with a two -thirds majority. The opposition created a ruckus in the House. While presenting the bill, Home Minister Amit Shah said that after the enactment of this law, no government will be able to run the government from jail. When these bills are made, the accountability of the Prime Minister, Chief Ministers of the states as well as the ministers of the Center and the states will be decided. The public will get a clean, corruption-free and transparent government.
If a case is registered against a leader in such an allegation in which the person will be in jail for 30 days after the allegations, whether the person will be in jail for 30 days, then he will have to resign immediately. If he does not resign, the President or Governor will be able to dismiss him. Tamil Nadu Chief Minister M.K. Stalin and West Bengal Chief Minister Mamata Banerjee opposed this bill, calling it a dictatorial step.
Opposition parties said that this bill is against the Constitution, its aim is to demolish the governments of opposition parties in the states, which will cause the basic principle of law, Innocent until Until Proven Guilty. Leaders of opposing parties have different tension, different types of fear. Opposition parties feel that the BJP is arranging to destabilize the opposition governments by enacting such a law so that any Chief Minister or Minister can be arrested in the power by arresting it in a fake case.
Mamta Banerjee said that in fact, this bill is the beginning of the elimination of democracy in India, in which someone will be declared guilty before the court’s decision, the governors will have the rights, the rule of the investigating agencies will come, they will fall on any opposition CM at the behest of the BJP.
Manish Tiwari of Congress described the 130th Constitutional Amendment Bill against the original structure of the Constitution. Ram Gopal Yadav of Samajwadi Party said another thing. He said that the BJP itself is digging its own grave, when it goes away from power, then the same law will become a problem for it. RJD leader Tejashwi gave the third angle. Said that the three bills have been brought to intimidate Nitish Kumar and Chandrababu Naidu as the Modi government does not have a majority. Showing fear of this law, BJP will put Nitish Kumar and Chandrababu Naidu in their court.
The bills presented have a background. In recent years, Arvind Kejriwal tried to run the government in Delhi by staying in jail. At that time, the central government and the court were helpless, because there was no provision in the law to stop someone from being in jail. In fact, in the initial stages, the lawmakers would never have thought that no minister or Chief Minister would resign even after going to jail. He never thought that the basis of morality would be buried in this way.
Surprisingly, the opposition parties are opposing the law against corruption. What will the opposed people answer to the people that a Chief Minister or Minister should run the government by staying in jail? Keep the ministry and keep taking decisions? To what extent is it justified? This is a legal reform, it was needed. Anyone has to leave the chair when he is arrested, it will now be surprised.
Attack on CM of Delhi: Find out the reason
A shocking incident occurred in Delhi. Chief Minister Rekha Gupta was attacked by a man. Rekha Gupta slapped, grabbed her hair and slammed them on the ground. The personnel deployed under the security of the CM immediately controlled the man. Rekha Gupta suffered injuries to the head, neck, shoulder and back in this attack. The Chief Minister’s Janata Darbar is held every Wednesday from seven in the morning. The attacking man reached the Chief Minister’s camp office under the guise of the complainant. Since the public is crowded in the court, there is not much frills of security. This person took advantage of this.
At the time when Rekha Gupta was listening to the problems of the people, the person came out of the line and broke on Rekha Gupta. Before the police could understand anything, he slapped Rekha Gupta and tried to pull her hair. The Chief Minister fell down in this sudden attack. The policemen tried to rescue the Chief Minister, beat him but he did not leave Rekha Gupta’s hair. The police somehow rescued Rekha Gupta from this person’s clutches.
In the initial investigation, this person has named the police as Rajeshbhai Sakharia. It is 41 years old, hails from Rajkot, Gujarat. The purpose of the attack is not yet known. But the police have found some evidence in the initial investigation that indicate that the attack was pre -planned, with full preparation, with planning.
24 hours before the attack, Rajesh recited the Chief Minister’s house. Rajesh reached Delhi on Sunday itself. Footage of CCTV cameras installed around the Chief Minister’s house has revealed that Rajesh reached near the Chief Minister’s house with a rickshaw, talked to the rickshawman, then a person was seen calling. After this, he made a video standing outside the Chief Minister’s house. On Tuesday, this man asked the security personnel outside the Chief Minister’s house how he could meet the CM. The staff wrote the address of the camp office to Rajesh Bhai Sakharia in a slip.
Delhi government minister Pravesh Verma said that this attack is pointing towards a big conspiracy. The accused stayed at the Gujarat Bhavan of Civil Lines, which is 800 meters from the CM’s camp office. It is clear that the attack on Rekha Gupta was done with complete planning. It is also clear that the attacker did not just intend to protest. The attack could have been fatal. The real reason for this will be revealed only after the police investigation is completed, but the effect of this incident will be that Rekha Gupta will not be able to get openly from the people.
Ever since Rekha Gupta became the Chief Minister of Delhi, she has been constantly among the people. His house and office were open to everyone, but now even if they want, the rules of security will stop them from living among the people. (Rajat Sharma)
