The Supreme Court said on Tuesday that every child has the right to love their parents. Whether both live separately or in different countries.

The court said that parents’ guidance and emotional cooperation cannot be stopped under any circumstances. A bench of Justice Vikram Nath and Justice Sandeep Mehta pronounced this decision in the case of stopping a father from talking to his son.

Actually, the father lives in India and the son is with his wife in Ireland. The father sought permission from the 9 -year -old son to talk on a video call.

The bench justified the father’s demand and ordered that the father can talk to the son on two hours video calls from 10 to 12 am on the time of Ireland on every other Sunday. The court also directed that both parents should ensure that this process is complete without any interruption.

Supreme Court said, parents quarreling, not good for child

Removing the child from father or mother has a bad effect on his development and future. The parents’ quarrel gives the child into unnecessary conflict, which is harmful to his life and mental health.
The child is to be denied his love and guidance. The court said that it is also the responsibility of the children to remain in touch with both mother and father, so that they can have a balanced development.

This petition was filed by Manoj Dhankhar against the order of Punjab and Haryana High Court on October 4, 2024. Manoj Dhankhar married Niharika on 26 November 2012. His son was born on January 18, 2016. But after 5 years separated. Applied for divorce.

After this, a dispute started between the two over the custody of the child. The father moved the family court in 2018. Initially, he was allowed to meet the child in school twice a month.

Later, in 2022, the court gave him custody for the last two of the week with certain conditions. In March 2023, the Family Court dismissed their custody petition, as they violated interim orders. The matter reached the High Court. Here in 2024, this decision was upheld, the court said that the child has been living with the mother continuously since 2017.
