Supreme Court
The Supreme Court has given an important order regarding the shout of Aashiq Allah Dargah and Sufi saint Baba Sheikh Fariduddin in Mehrauli, Delhi. The court made it clear that no new construction or change will be done here. Hearing of the case, Justice B.V. Nagratna and Justice R. Mahadevan’s bench did it.
Why do you want to break it?
During the hearing, Justice Nagratna asked the Delhi Development Authority why do you want to break it? To which the DDA replied that this area belongs to the forest area and we have objections with additional construction near the dargah.
ASI considers 12th century monument
Advocate Nizam Pasha argued that the Archaeological Survey of India has considered this dargah as a 12th century monument. Therefore, the opinion of a religious committee has no relevance. He also claimed that there is no unauthorized construction here. It was said by the DDA that the ASI would preserve the part of the structure to preserve.
This case had reached Delhi High Court earlier
The dispute started with a PIL, demanding the Delhi High Court to stop the dargah and Chilgah from being demolished. The High Court had settled the petition saying that these monuments are not protected monuments. A petition was filed in the Supreme Court against this order of Delhi High Court.
There will be no tampering in the current situation- SC
The Supreme Court at present made it clear that there would be no tampering, sabotage or new construction in the current situation of the Dargah and Chilgah. This means that currently these historical and religious structures of Mehrauli have got protection from any kind of sabotage action.
