Supreme Court gave instructions

The Supreme Court has ruled on the petition filed demanding the appointment of two women in the army in the JAG core. Justice Manmohan read the verdict and said, the executive cannot reserve vacancies for men. 6 seats for men and 3 seats for women are arbitrary and cannot be allowed under the guise of recruitment. The true meaning of gender neutrality and 2023 rules is that the Center will select the most qualified candidates. Limiting women’s seats is a violation of the right to equality.

Supreme Court canceled 2: 1 reservation policy



The Supreme Court on Monday canceled the 2: 1 reservation policy for male and female officers at the Judge Advocate General (JAG) branch of the Indian Army and said that vacancies for men cannot be reserved or banned for women. The court described this practice as a “arbitrary” and a violation of the fundamental right to equality. A bench of Justice Manmohan and Justice Dipankar Dutta said, “Executives cannot reserve vacancies for men. Six seats for men and three seats for women are arbitrary and cannot be allowed under the guise of recruitment.”

Supreme Court gave instructions to central government

The Supreme Court has directed the Central Government, the central government should recruit the above manner and publish a joint merit list of all the candidates which includes male and female candidates. The petition filed in the court challenged disorganized vacancies for men and women.

Along with this, the Supreme Court also canceled the army’s policy, which was asked to reserve more JAG posts for men than women. The Supreme Court said- this is against equality. In fact, the Supreme Court today canceled the policy of the Indian Army under which the number of women candidates appointed to the post of Judge Advocate General was limited.

Selection of qualified candidates

The Supreme Court said that the true meaning of gender neutrality is that all eligible candidates, irrespective of their gender, should be selected. Therefore, the Supreme Court directed the Central Government and the Indian Army to recruit in JAG in such a way that there is no division of seats for any gender, that is, if all women candidates are qualified, then all of them should be selected.
