The winter session of Parliament starts on Monday 21 July 2025. The eyes of the entire country are on this session. The government and all opposition political parties have completed their preparations for the monsoon session. Before the commencement of this session, let us tell you about Article 85 of the Constitution of India which controls the entire Parliament.
What is the characteristic of Article 85?
In the Constitution of India, Article 85 is related to the session of Parliament or the abuse, the session (termination of the session) and disintegration. Article 85 gives the President of India the power to call a Parliament meeting or postpone it. This article empowers the President to call both the House of Parliament from time to time to meet and where he is considered appropriate. There is also a rule that there will be no gap of 6 months in the last meeting in the session and the date of the first meeting of the next session.
Major things of Article 85
Article 85 of the Constitution of India makes provision that Parliament will organize two sessions every year. First- Budget session (between February to May), second- monsoon session (between July to September). The President of India has the right to call and postpone these sessions. Its time is decided with the advice of the Speaker of the Lower House Lok Sabha and the Chairman of the Upper House Rajya Sabha. Along with this, a special winter session is also organized in Parliament in November and December.
- Article 85 (2) (a)- These parts of the Constitution are related to the seats of Parliament. Let us tell you that prostitution means ending its session without dissolving Parliament. Also tell that the prostitute and adjournment are different. The adjournment stops the proceedings of the session of Parliament temporarily.
- Article 85 (2) (b)- This part of the Constitution of India is related to the disintegration of Parliament or especially the lower house Lok Sabha. According to this, on receiving the advice of the President of India, the Prime Minister, the Lok Sabha can be dissolved even before the completion of its 5 -year term and after that the general election for the new House can be held. Let us tell you that the Upper House is Rajya Sabha Permanent House. It does not disintegrate.
Why is Article 85 important?
Article 85 of the Constitution of India is very important for operation in charge of Parliament. Article 85 regularly directs the sessions of Parliament and facilitates discussion on various issues within the House and ensures the accountability of the ruling party. Along with this, Article 85 of the Constitution regulates the session of Parliament, the prustigns, and the disintegration of the Parliament and maintains the power balance between the executive and the legislature.
