The Supreme Court on Tuesday approved a divorce application of a couple and also directed the person to hand over the flat of four crore rupees to the wife living separately. A bench of Chief Justice BR Gavai, Justice K Vinod Chandran and Justice NV Anjaria also canceled against the person Section 498-A (cruelty to women), 406 (criminal betrayal) and criminal proceedings initiated under Section 34. The apex court said that there are bitter relations between the two sides for the last eight years and many legal proceedings are pending, which gives clear indication that their marriage is “completely broken.”

What did the court say?

The bench said, “We also accept the application filed under Article 142 of the Constitution, requesting to abolish the marriage between the appellant and the other defendant. The application is for the best interest and complete justice in the best interest of both sides, as it has been found that the marital relationship is completely broken.” The apex court said that the claim of alimony and the claim is not appropriate, especially given the unemployed situation of the appellant. The apex court directed the former banker to deposit the dues in the Housing Society by September 1, 2025 as the maintenance fee of the apartment. The apex court stopped all civil and criminal proceedings initiated by the parties of marriage. The bench said, “No civil or criminal action will be initiated by the concerned parties on any aspect related to marriage.”
