Witness to Malegaon blast case missing for 17 years, court declared ‘civil death’

Indore: Dilip Patidar, a witness to the 2008 Malegaon blast case, has not been able to find any clue even after 17 years of his mysterious disappearance and a court in Indore has declared his “civil death” on his family plea. A lawyer of Patidar’s family gave this information on Friday.
What is civil death?
‘Civil death’ means that when a person is missing for 7 years or more and no clue of him is found, he is legally declared dead. All rights of that person are ended. This crime can occur under various circumstances including a person’s missing. For example, if a person is lost for seven and more time, then he can be declared a civil mother by putting a petition on behalf of his family. Admittedly, this petition has been filed by the wife of that missing person, then all the rights of that person are eliminated when his civil death is declared. Wife gets various rights including property, second marriage.
What is the whole matter of Dilip Patidar?
The family members of the Patidar say that the Maharashtra Police’s Anti-Terrorism Squad (ATS) personnel had taken them from Indore on the intervening night of 10 and 11 November 2008 for questioning in the Malegaon blast case and so far the Patidar has no idea. Patidar’s family lawyer Deepak Rawal said, “Despite all efforts, no clue about Patidar could be found. Finally, we had to file a lawsuit in the local court on behalf of his family to declare his civil death so that his dependents could get legitimate benefits and rights on the basis of it. ”
‘Walked for testimony, did not return home again’
A civil court in Indore declared his civil death on 19 December 2018 on the trial of Patidar’s wife Padma and his son Himanshu. The 21 -year -old Himanshu said that the Maharashtra ATS policemen had taken his father with him saying that he was being taken for testimony and would be released after recording the statement, but he did not return home after that. Later, the ATS officials kept claiming that he had left my father, but he never gave us any confirmed information about this. ”
What did Dilip’s only son say?
Himanshu is the only child of Dilip Patidar and Patidar’s wife is a housewife. Patidar’s son said, “My family fought a long legal battle to find out my father, but the result was cipher. My family’s financial condition is not good since the father’s disappearance. The government should help us. ”Electric Mistry Patidar by profession, relative of Ramchandra Kalsangra alias Ramji, the wanted accused in the Malegaon blast case. He was also a tenant in a house in Kalsangra in Indore. Kalsangra’s son Devavrata said that like the Patidar, his father has no idea for the last 17 years.
Sandeep Dange also missing since 2008
Similarly, Sandeep Dange, another wanted accused in the Malegaon blast case, has also been missing since 2008. Dange’s 88 -year -old father VK Dange lives in Lokmanya Nagar, Indore. He has also been constantly saying that he has no information about where his son is. A total of 12 accused were arrested by the Maharashtra ATS in the Malegaon blast case, while Kalsangra and Dange were declared fugitives. On September 29, 2008 in Malegaon, six people were killed in explosives tied to a motorcycle near a mosque, while 101 others were injured. (With language inputs)
