Complaint about collusion of ROC with UPCA reached Corporate Ministry
Kanpur, 01 December (HS). The irregularities taking place in Uttar Pradesh Cricket Association (UPCA) are not showing signs of decreasing. Mohsin Raza, former minister of Uttar Pradesh government and cricketer, has opened a front against the irregularities of UPCA. This gave strength to others and now UPCA’s complaint has reached the Secretary of the Corporate Ministry. The complaint alleges that financial scams, fraud and misuse of players’ money have been carried out within the association in connivance with UPCA and Registrar of Companies (ROC) Kanpur officials.
Complainant Upendra Yadav has registered in his complaint through email to the Secretary of the Corporate Ministry that despite several complaints of financial irregularities made by the Sangh officials, no action has been taken till now. The role of ROC officials in the matter also clearly appears suspicious. UPCA, which is functioning as a private limited company, misused the powers of its Board of Directors and got the amended Articles of Association (AOA) approved by ROC Kanpur, in gross violation of the rules. The mail showed that the association had declared three of its directors as non-retiring directors. Unfortunately, two of these directors passed away in 2018 and one director has been disqualified due to non-KYC compliance. Despite this, ROC Kanpur approved the revised AOA in 2022. In which the rule of non-retiring director was added to these three directors. This clearly shows ROC’s collusion and lack of verification.
–Mistakes happened with the connivance of ROC
The complainant states that it was the duty of the ROC to ensure that it is in accordance with all legal provisions and the actual situation before approving the revised AOA. The allegation is that an attempt has been made to earn profit under the guise of a non-profit organisation, whereas as per MCA rules, any non-profit organization registered under Section 8 cannot earn profit and its income must be used only for public interest. Needed UPCA, in connivance with ROC Kanpur, violated this rule and embezzled money and earned profit.
–Scam worth around Rs 3 crores
Reportedly, the ROC not only maintained silence on the illegal activities of UPCA directors but also encouraged tax evasion and misappropriation of funds by supporting it. Due to which the interests of the players and the government have been harmed. Told that in 2022, an expenditure of Rs 297.89 lakh was shown in the name of stadium construction, whereas no construction work was done at the said site. UPCA directors committed a financial scam by misleading players and the public. ROC Kanpur allowed the directors of the association to violate the rules with impunity. The complainant has made a demand to the Secretary stating that the role of ROC Kanpur should be thoroughly investigated and action should be taken against the officers responsible for the lapse in verification.
–DINs of directors should be canceled
The complainant says that the Director Identification Number (DIN) of the directors of the association should be immediately canceled and they should be declared ineligible to become directors in future. An independent observer should be appointed, so that transparency can be brought in the functioning of the association and the future of the players can be secured. The cases of financial scams and tax evasion in collusion between UPCA and ROC Kanpur should be investigated and strict action should be taken against the culprits. The bank accounts and properties of the Sangh should be sealed immediately so that further embezzlement of funds can be stopped. A special audit of the union’s balance sheet and its expenses should be conducted by CAG or any other independent agency. The collusion between the association and ROC Kanpur has not only made a mockery of the tax system and government rules but has also hurt the confidence of the players and the public. There is a need to immediately stop such irregularities and take strict action. A demand has been made to the Secretary to give priority to this matter and take immediate action to give strict punishment to the culprits and bring transparency in the functioning of UPCA.
