Innocent person made accused in case of molestation of woman
Palpal correspondent, Jabalpur/Satna. In Satna, MP, Police Sub Inspector (SI) prepared a false charge sheet by making an innocent youth an accused in the case of molestation and assault of a woman. Even declaring the young man absconding, a reward of Rs 10,000 was declared. After this, a warrant was also issued against the youth from the Satna district court.
Raja, Ramji and Kailash Chaudhary, residents of Khamaria village of Satna, had gone to a wedding ceremony in Ghurdang village (Satna) on 28 April. After this, on May 4, a 32-year-old woman lodged a complaint at the Kolganwa police station, alleging that Raja, Ramji, Kailash and Vikas had assaulted and molested her. The woman also alleged that she had a dispute with vegetable trader Raja Chaudhary a few days ago over money.
To take revenge, he along with his friends beat him. Kolganwa police station registered a case against the four youths. Even three accused Raja, Ramji and Kailash were arrested from their house. When the police reached the house of the fourth accused Vikas to arrest him, his father Moolchand told that the son has been in Navdaphata, Maharashtra since April 4. The allegations leveled against him are wrong.
The investigating officer in this case was Sub Inspector Amrish Dwivedi. The police kept reaching Vikas’s house and interrogating the family. On June 1, 2024, Satna SP declared Vikas a criminal and announced a reward of Rs 10,000 on him. SP took this action on the report of Kolgawa TI. The young man’s family remained troubled for 8 months. Sometimes the police came to his house and sometimes called the family to the police station and made them sit for interrogation for several hours.
On June 28, 2024, SI of Kolganwa police station and the investigating officer of the case Amrish Dwivedi reached Taleja (Raigad Maharashtra). He called Vikas from the bus stand itself and then reached the factory with Vikas. After reaching the factory, we saw the CCTV camera of 28th April 2024, the same day the incident took place, in which Vikas was added.
The CCTV footage clearly showed that Vikas was working in the factory. During interrogation by SI, factory owner Vinod Khanwalkar told that Vikas had returned to work only on April 4. Since then he has been coming every day. After taking the CCTV footage installed in the SI factory and the location of Vikas Tower, he returned to Satna on June 31 after making a Panchnama. SI returned to Satna and prepared the charge sheet of Vikas Chaudhary. Misleading the officials and the department, neither gave CCTV footage of Vikas’s factory. Neither the statement of the factory owner nor the details of Vikas’s mobile location were given. On August 5, 2024, Kolganwa police station presented the challan in Satna District Court. On August 8, 2024, Vikas’s father filed a petition for anticipatory bail of his son. This was rejected by the court.
The SI misled everyone from the station in-charge to the SP. A reward of Rs 10,000 had been announced on Vikas. In such a situation, the police had intensified efforts to arrest him. After the anticipatory bail plea was rejected by the District Court, Vikas’s lawyer Deepak Tiwari filed a case in the Jabalpur High Court on 23 September 2024. Justice Vivek Aggarwal heard on 4 October 2024. Advocate Deepak Tiwari told the court that Vikas, whom Satna police had declared absconding, has announced a reward of Rs 10,000 against him. He was in Maharashtra on 28 April 2024.
SI Amrish Dwivedi had also gone to Maharashtra and interrogated Vikas. The advocate also presented its photo and Panchnama in the court. The High Court ordered the Satna SP to come to the court with the affidavit and fixed the next hearing. On November 9, Satna SP Ashutosh Gupta instructed the CSP to investigate after seeing the case diary. On November 21, the CSP told the SP in its investigation report that the investigating officer Amrish Dwivedi had shown serious negligence in the case. The diary was presented in the court without informing senior officials. CSP also wrote in its report that a departmental inquiry should be conducted against them.
From Vikas’s father Moolchand to the complainant woman were interrogated. Along with this, the factory in which Vikas works. Also talked to the owner of that factory Vinod Khanwalkar on phone and saw all the CCTV footage. The SP also admitted that the SI had been negligent in the investigation. Satna SP had to apologize in this case in the High Court. It is noteworthy that the young man was in Maharashtra when the incident of assault and molestation of the woman took place. He works in a factory there.
During the investigation, the SI also found evidence of the youth’s innocence, but he deliberately made him an accused. Till the re-investigation report in the case came, SI Amrish Dwivedi was transferred to Rewa. Satna SP wrote a letter to Rewa IG on November 15 and said that Amrish Dwivedi was negligent during the investigation of Vikas Chaudhary case. Misled the department officials. Therefore, action should be taken against Dwivedi. On the instructions of IG, Rewa SP suspended the SI.
On November 19, Satna police presented its final report in the district court and said that the allegations of assault and molestation of the woman against the accused Vikas Chaudhary could not be proved. On 26 November, Satna Police presented an affidavit in the High Court and apologized. The High Court acquitted Vikas, declaring him innocent. Satna SP also apologized in front of the court.
