National Herald Case: The famous National Herald case was heard on Wednesday at Rouse Avenue Court in Delhi. The hearing was held in the court of Special CBI/ED Judge Vishal Gogne, in which former Congress President Sonia Gandhi, MP Rahul Gandhi and others have been accused. During the hearing, the ED said that people were paying fake advance fare for years. The rented receipts were fake. AJL was given advertisement money on the instructions of senior Congress leaders. The ED said that any income from such fraud is ‘income of crime’.
Mention of fake transactions
The ED said that some donors who are well-known big names and senior leaders of the party have paid some amount in the form of rent, so if it is considered the income of the crime, then why will they not be made an accused? One accused Suman Dubey transferred shares to Sonia Gandhi. Oscar Fernandez transferred shares to Rahul Gandhi and Rahul sent it back to Oscar Fernandes. These are all fake transactions. These are only on paper. The ED said that by 2015, only two people are among those who are benefited, they are Rahul and Sonia Gandhi. The beneficial person is the one who has control over the company.
Assets obtained from crime
The court asked the ED, “Is rent, advertisement money etc. are also considered to be the property obtained from the crime i.e. Procedure of Crime.” On behalf of ED, ASG SV Raju said, “Yes, whatever is the property acquired from fraud will come in POC.”
Court question about POC
The court said, “These three categories are not clearly shown as POC. These have been introduced only as a few points. The fare is also in two categories- 29 crores and 142 crores. While 142 crores are called POC, 29 crores have not been called so.
Court- He was not made an accused?
The court said, “We are asking this because some donors you are saying that they are giving fake donations, they are also members of the same party and some are also prominent faces. But they have not been made accused. If the advance fare and donation are considered POC, will they not come in the category of the response.
ED’s answer on court question
To this, ED replied, “We are investigating the issue whether an property comes to POC when it is obtained or before.” The court said, “Our aim is only to understand what the ED is considering POC and who is not.” ED said, “In the current stage we consider these things as POC. We can investigate further and it will be included in the Supplementary Chargesheet.” ED said that we will also file a further supplementary charge sheet in this matter.
