New Delhi: The police have arrested a man for giving ‘triple talaq’ to his first wife through a WhatsApp voice message. The accused, Abdul Ateeq, a 32-year-old transporter from KRK Colony in Adilabad town, has been charged in the case. According to G Srinivas, the sub-inspector of Adilabad Police, Ateeq married Jasmine in 2017.

The couple was blessed with two daughters, but marital discord soon set in, leading to frequent fights. For the past two years, they have been living separately, with Jasmine residing with her mother and daughters. Meanwhile, Ateeq remarried. In 2023, Jasmine filed a harassment case against Ateeq, Times of India reported.

Additionally, Jasmine filed for maintenance in court, resulting in an order for Ateeq to pay Rs 7,200 per month for the upkeep of their daughters. However, Ateeq failed to comply with this order, prompting Jasmine to approach the court again. The court then issued summons for Ateeq to appear. Enraged by these developments, Ateeq sent a WhatsApp voice message to Jasmine, declaring ‘triple talaq.’ Jasmine shared this message with relatives from both families, who advised her to file a legal complaint.

Instant triple talaq unlawful

The Women (Protection of Rights on Marriage) Act criminalises the practice of instant divorce through ‘triple talaq.’ “The accused has been arrested and will be remanded to judicial custody,” said SI Srinivas. “This is the first case in Adilabad where we have applied this section alone. Previously, we have registered two cases where this section was added alongside harassment charges.”

43-year-old man arrested for giving triple talaq

Earlier this year, a 43-year-old man in Navi Mumbai faces charges for allegedly giving triple talaq to his wife at her workplace, a college in Kharghar, in December. The Kharghar police registered the case under the Muslim Women (Protection of Rights on Marriage) Act, 2019, following the wife’s complaint. No arrests have been made yet.
